PLEASE READ THIS AGREEMENT CAREFULLY BEFORE PURCHASING AND USING SOFTWARE OR SERVICES FROM WBCOM DESIGNS. BY PURCHASING OR USING WBCOM DESIGNS SOFTWARE OR SERVICES, YOU SIGNIFY YOUR ASSENT TO AND ACCEPTANCE OF THESE TERMS AND CONDITIONS AND ACKNOWLEDGE YOU HAVE READ AND UNDERSTAND THESE TERMS AND CONDITIONS. IF YOU ARE AN INDIVIDUAL ACTING ON BEHALF OF AN ENTITY, YOU REPRESENT THAT YOU HAVE THE AUTHORITY TO ENTER INTO THESE TERMS AND CONDITIONS ON BEHALF OF THAT ENTITY. IF YOU DO NOT ACCEPT THESE TERMS AND CONDITIONS, THEN YOU MUST NOT USE WBCOM DESIGNS PRODUCTS, SOFTWARE OR SERVICES.

Plugin Licensing

Wbcom Designs plugins and themes are licensed under the GNU General Public License (http://www.gnu.org/licenses/gpl.html) version 3.0 or later.

Warranty

We are not responsible for any plugin or theme compatibility conflicts that may occur. The Software is purchased “AS IS” and WITHOUT ANY WARRANTY. We, at this moment, disclaim any warranty not expressly provided herein, including but not limited to the warranties of MERCHANTABILITY and FITNESS FOR A PARTICULAR PURPOSE. You use the Software at your own risk. We do not assume responsibility for any data loss resulting from the installation of the Software. Additionally, our liability for any harm resulting from your use of the Software is limited as stated herein.

Support

Support Services for purchased products are available via our support page for all accounts for which there is a current and active Subscription. If you wish to receive support after one year, renew your subscription or purchase a new license key. Subscription is subject to 30% of the base price. Support is not available for accounts without an active Subscription. 

 

Support requests are handled in the order they are received, on a first-come, first-served basis.

We will undertake Commercially Reasonable Efforts to resolve issues promptly, courteously, and professionally. However, we make NO WARRANTY of any kind regarding the Software or whether the use of Support Services may resolve any particular issue. You use our Support Services at your own risk. We are not responsible for any harm, including but not limited to data loss, that may occur due to using our Support Services, and our liability for harm resulting from your support use is expressly limited as provided herein.

 

Our customer support team can assist you from Monday to Friday, excluding major holidays, between 10:00 AM and 10:00 PM (+5:30 GMT). If you submit an inquiry outside of these hours, we will respond on the next business day.

 

Please note that we only offer support for the WordPress products that we have developed. We ensure compatibility with the latest WordPress version for all our products. However, we cannot guarantee that our products will work with older versions of WordPress.

Automatic Updates

Automatic updates are available to license holders with an active and valid subscription and license key.

 

Automatic updates are available for both plugins and themes. Automatic updates are available as long as the license key generated from the purchase is valid and active.

License Usage

Wbcom Designs grants each customer one or more non-transferable license(s) to use the Software for internal use, as defined by the terms set in the customer’s chosen license package for support and updates.

Where the license package enables auto-update and makes the active site eligible for support requests, the customer/license-holder may not sell the originally purchased license key provided by Wbcom Designs to other license users (such as clients) for commercial benefit. The customer may not sublicense any rights to distribute the license key to any person or entity. Wbcom Designs will only provide support services to the original customer/license-holder with a legitimate license key and consider any other use of this license key for support queries to be fraudulent.

Plugin/Theme Delivery

After we have processed your payment successfully, you will receive an email with your order number and other purchase information. Your license key is available in your account area, along with your plugin downloads. You can download the plugin by logging into the account created for you at the time of purchasing the plugin and clicking on the appropriate link.

Should you have yet to receive an email containing your information, you can contact us through https://wbcomdesigns.com/support/ to request your purchase information.

Access to re-download purchased files is contingent on the validity of your license key. Should your license key expire, your ability to download the associated files will be temporarily suspended until the license key is renewed.

Ownership

Wbcom Designs, along with its licensors, owns and will continue to hold all the rights, titles, and interests, including intellectual property rights, to the products, services, documentation, imagery, and content (available at wbcomdesigns.com) provided under these Terms, and all the elements associated with them. Except for the licenses expressly granted herein, you do not possess nor acquire any rights, titles, or interests in or to any preceding or associated elements. Furthermore, you acknowledge and agree that you will not bundle any Wbcom Designs product with other products like WordPress themes to be distributed in online marketplaces.

Price Changes

Wbcom Designs reserves the right to modify, change, cancel, or upgrade a plugin subscription and license key without prior notice or consent. Prices of all products are subject to change without prior notice or consent.

Subscriptions & Automatic Renewal

Wbcom Designs extensions are sold as automatically recurring subscriptions that renew each year on the anniversary of the purchase date. This applies to all paid-for plugin and theme licenses.

This subscription will automatically renew at the end of the annual license term unless the purchaser cancels their subscription before the automatic renewal date.

Please note the following details of Wbcom Designs extension license subscriptions:

Subscription renewals are automatically processed annually on the anniversary of your original purchase. The license renewal will continue and remain valid for each (1) year unless the subscription is canceled before the renewal date.

    • You may cancel your subscription anytime from your Account page on the Wbcom Designs website.
    • If you choose to cancel your subscription, you will no longer receive updates and support for the extension when your license expires.
    • If you choose to renew your subscription after it has been canceled and your extension license has expired, you will be charged the current listed price for the plugin/theme license. We cannot apply older or initial pricing to your new renewal purchase.

We cannot grant refunds on renewal payments. We will send you an email two weeks before your renewal date, and you may use this opportunity to cancel your subscription before the renewal payment is automatically processed.

If you cancel your subscription, your license will expire on the anniversary of the original purchase, and you will no longer receive updates and support for the Wbcom Designs extensions you purchased.

Refund Policy

We firmly believe in and stand for our products 100%, but we understand that they cannot always work correctly for everyone. If you want a refund, please open a “Refund Request” support ticket. When ordering a refund, we respectfully ask you to make sure you comply with the following refund policy conditions:

Eligibility conditions for a refund request:

    • You are within the first seven days of the original purchase of the plugin.
    • We cannot grant refunds after the first seven days of the original purchase.
    • We cannot grant refunds on renewal payments. We will send you an email two weeks before your renewal date, and you may use this opportunity to cancel your subscription before the renewal payment is automatically processed.
    • You have an issue we cannot resolve, making the system unusable. We may ask you questions regarding the nature of your refund request so we can improve the plugin in the future.
    • If your issue(s) comes from not being able to install the plugin correctly or get the plugin to perform its essential functions, we will happily consider your refund request.
    • You have contacted our support team and allowed us to attempt to resolve your issue(s) or have explained why the plugin will not work for you.
    • Please note that technical issues caused by 3rd party plugins, themes, or other Software will not provide grounds for a refund.
    • You agree to deactivate and uninstall the plugin from your site if a refund is granted.

Refunds will be offered at our sole discretion. By purchasing plugin(s) from our site, you agree to this refund policy and relinquish any rights to subject it to any questions, judgment, or legal actions. We are not liable to cover any differences in exchange rates between the time you purchased and the time you are refunded.

Non-Refundable Payment Policy for Custom Development Services

In addition to the above terms, please note the following specific terms related to custom development services:

  1. Scope of Non-Refundable Policy: This non-refundable payment policy applies exclusively to custom development services offered by Wbcom Designs. It does not affect the refund policy for other products, such as plugins and themes, governed by their terms.
  2. No Refunds for Custom Services: All payments made for custom development services are final and non-refundable. Once a client engages Wbcom Designs for custom development work and payment is processed, it is deemed complete and non-refundable under any circumstances.
  3. Acknowledgment of Service Nature: Custom development services are bespoke, tailored to individual client specifications, and require resource allocation from Wbcom Designs. Therefore, once work on a project has commenced, we cannot offer refunds.
  4. Client Responsibility: Clients are responsible for providing precise, comprehensive project requirements and specifications before the commencement of work. Wbcom Designs will work according to these specifications, and any changes or additions may incur additional charges.
  5. Project Abandonment: Any payments made remain non-refundable if the client abandons or delays a project. Wbcom Designs reserves the right to bill for the total amount of the agreed-upon project fee if work has already commenced.
  6. Dispute Resolution: In the unlikely event of a dispute, Wbcom Designs commits to working with the client to reach a mutually satisfactory resolution. However, this does not include the provision of refunds for services rendered.

By commissioning custom development services from Wbcom Designs, you acknowledge and agree to this Non-Refundable Payment Policy. This policy is intended to recognize the significant resources and planning involved in custom development projects.

Email

Wbcom Designs may occasionally email you about purchasing our company’s product(s). We may also send you occasional newsletters regarding plugin and theme updates and promotions. We will never sell or release your email to any third-party vendors. You may opt out of these emails at any time without penalty.

License Agreement

By purchasing our product(s), you indicate and consent that you have read and agree to the Terms and conditions listed and detailed on this page. We reserve the right to change or modify the current Terms and Conditions without prior notice or consent.

We provide support for products purchased from us on wbcomdesigns.com. We only support anyone who has purchased the products from our store. You must have an active license to receive premium support. Support can only be provided to the person/company that purchased the license. A license is non-transferable. We will only support the license on the domain you have activated the license on and your staging server. The staging server must be on the same domain name. 

Support Times

We aim to respond to premium support questions within 12 hours during the week (Monday – Friday) and 24-48 hours on weekends (Saturdays and Sundays).

Server Access

Sometimes, we will require a login to your WordPress install or even your web hosting panel to diagnose and fix issues.

We encourage all our customers to run staging servers so that they can test and develop before publishing this to their website. This ensures your business continues to operate while you try updates or possible issues.

We cannot be held liable for any consequences arising from the access you grant us. You are responsible for ensuring your website’s data integrity, security, and availability. We highly recommend that customers take a complete backup and run a staging server before granting our premium support access.

Bugs

We are continuing to update and advance our products. To this end, new or existing bugs may come to light. If you find a bug or think you have found one, please report it to our support team, and we will investigate if this is a security issue; then we will work on a bug fix and release it as soon as possible. For other bugs that are noncritical, they will be released in the next version of the Software. If you need the bug fixed before this, please request it from support, and we will do what we can to accommodate your request.
